Total salaries tax is capped at the two-tiered standard rate — 15% on the first HKD 5 million of net assessable income computed before personal allowances, and 16% on the remainder — whenever that produces less tax than the progressive schedule above.

Hong Kong's salaries tax applies progressive rates from 2% to 17% on net taxable income after allowances and deductions, but the total is capped at a two-tiered standard rate of 15% on the first HKD 5 million of net assessable income (computed before personal allowances) and 16% on the remainder.

In practice

Residency

Residence, domicile, and citizenship do not determine liability to Hong Kong salaries tax, which is charged on a territorial basis regardless of an individual's residence status. Where residence must be established, such as for a tax treaty, an individual who ordinarily resides in Hong Kong, or who is present for more than 180 days in a year of assessment or more than 300 days across two consecutive years, is generally treated as a Hong Kong tax resident.

Filing

The year of assessment runs from 1 April to 31 March. Tax returns are issued on the first working day of May, with a filing deadline usually about one month after issue (extended by a further month when filed through a tax representative), and tax is normally paid in two instalments falling in January and April of the following year.

Non-residents

Hong Kong salaries tax applies the same progressive rates to residents and non-residents alike, charged on Hong Kong-sourced employment income, office income, and pensions regardless of the recipient's residence status.

Deductions

Beyond expenses incurred wholly, exclusively, and necessarily in producing assessable income, Hong Kong allows a short list of concessionary deductions: qualifying Voluntary Health Insurance Scheme premiums, charitable donations (capped at 35% of assessable income after deductions), elderly residential care expenses, self-education expenses, mandatory and voluntary MPF retirement contributions, home loan interest, and domestic rent, each subject to its own annual cap. There is no general standard deduction.

Special regimes

VAT

No VAT, goods and services tax, or general sales tax is levied in Hong Kong. Indirect taxation is limited to duties on specific dutiable commodities such as tobacco, liquor, and hydrocarbons, plus stamp duty on property and share transfers.

Capital Gains Tax

Hong Kong SAR does not levy a capital gains tax; gains realized by individuals from the sale of listed securities are not subject to tax.

Crypto Tax

Hong Kong's Inland Revenue Department confirms that profits from the sale of capital assets are excluded from profits tax, and that where digital assets, including cryptocurrency, are acquired and held for long-term investment, any profit from their disposal is not chargeable to profits tax. Whether a holding is a capital asset or trading stock is decided case by case using established 'badges of trade' principles; profits from cryptocurrency trading, exchange, or mining conducted as a business are chargeable to profits tax.

Wealth Tax

No net wealth tax levied. PWC's dedicated "Net wealth/worth taxes" subsection states: "There are no net wealth/worth taxes in Hong Kong SAR."
